The law in Illinois, in plain English
The Illinois Gaming Board licenses the books under the Sports Wagering Act of 2019. Since July 2025 the state has charged online books 25 cents on each of their first 20 million wagers a year and 50 cents after that, on top of its tax on their revenue, and some books pass part of it to customers: FanDuel restored a 50-cent fee on smaller wagers in October 2026. A bill to repeal the per-wager tax has not passed.
Prediction markets are open in Illinois while the courts decide who regulates them. The Gaming Board has sent cease-and-desist letters to Kalshi, Polymarket and others, and a 2026 budget law (SB 3019) tried to license and tax them. In October U.S. District Judge Martha Pacold blocked the state's rules in suits by Kalshi, Coinbase and the CFTC, and Illinois has appealed to the Seventh Circuit. Novig, a CFTC-regulated exchange, is available to Bears fans in the state.
